Trustee of a will is an often misused phrase–here’s why. People responsible for probating wills are referred to as executors of a will. Those responsibile for administering a trust are referred to as trustees of the trust. The phrases, trustee of a will or executor of a trust are simply the mismatching of titles and instruments.
Did you know there are two different approaches to administering wills and trusts. The correct path is determined by reading the document in question. Does the heading include the word “will” or “trust”? If it is will, the person in charge is called an executor, and the document should be filed with the court to open probate. If it is trust, the person in charge is a trustee and the trust estate is administered privately.
