Trust Attorneys do everything from create estate plans, administer trusts, and litigate trust matters. They may be hired by individulas to create estate plans or by Trustees to help administer trusts, defend trusts from attacks, prepare trust reports and accounts, recover trust assets, prosecute or defend legal actions involving trust assets or debts, and for any other trust related purpose. Trust Attorney fees are paid by the Trustee directly from the Trust.
Unlike probate administration where attorney fees must be based on the monitary value of probate estate assets, trust attorney fee agreements can and do vary depending on the type of services performed. Estate plans are usually billed as a flat fee, trust administration can be a hourly or based on a percentage of the trust’s value, trust litigation matters can be based on hourly or contingency fees.
