Q
What does it mean to "Contest a Will?"

A
A Will contest is a challenge to a Will, usually initiated by a family member or a beneficiary who feels slighted by the testator's choice of property distribution. Valid grounds for to contest a Will include claims that it was improperly executed (e.g., the testator did not sign it) or the testator lacked testamentary capacity (e.g., that the person did not understand what they were was doing at the time). One can also challenge a Will on the grounds it contains a mistake or that the document is the result of fraud, undue influence, duress, or insane delusion upon the person creating it.
